Could an error on a court form mean the re-opening of historical divorce settlements?
A version of the financial disclosure form (Form E) – which was previously available on the HMCTS website – contained an error in its automatic calculator software.
It is likely that this version of the form will have been used in many divorce cases and may necessitate the reopening of negotiations in some, in order to rectify mistakes made as a result.
Those most affected are likely to be litigants in person, since most solicitors have their own form-package software. The Ministry of Justice has acknowledged the error and it is understood that they are currently investigating the matter.
