Our Private Client services team can assist with:

  • Preparation of wills, codicils and advance directives (‘living wills’)
  • Advice on tax planning during lifetime and on death
  • Preparation and registration of both property and affairs and health and welfare Lasting Powers of Attorney (LPA), plus advice relating to attorney services
  • Administration of simple and complex estates and will trusts, including related tax issues and the creation of deeds of variation
  • Creation and administration of trusts, including:
    – Life Interest Trusts
    – Trusts for minors and people with disabilities
    – Discretionary Trusts and Personal Injury Trusts (which can safeguard entitlement to means-tested benefits after receiving a personal injury award);
  • Court of Protection advice, including applications for a Deputy, i.e. someone appointed by the Court of Protection to manage the affairs of a person who has lost capacity but has not planned ahead by making an LPA (or an Enduring Power of Attorney before 1/10/07)
  • General advice for elderly and incapacitated people, and their carers
  • Contentious Probate matters including:
    – Written advice and representation on claims under the Inheritance (Provision for Family and Dependants) Act 1975
    – Disputes between Executors and Trustees
    – Claims against wills due to lack of capacity, lack of knowledge and approval, undue influence
    – Mutual wills
    – Proprietary and promissory estoppel
  • Advice on and applications for reimbursement of care and nursing home fees
