Lyons Davidson successfully defends health & safety prosecution
Ben Derrington, head of the Regulatory Corporate Crime department at Lyons Davidson, has successfully defended a joint prosecution brought by the CPS and Health and Safety Executive for gross negligence manslaughter and breach of the Health and Safety at Work Act 1974 and the Construction (Design and Management) Regulations 2007.
The prosecution arose following the death of a worker during construction of a major sports stadium in 2010. After a six-week trial and four year-long investigation, our client, the managing director of a concrete installation business, was unanimously acquitted on all counts after four hours of deliberation by the jury.
