Current News

The team at Lyons Davidson have been involved in a number of high profile cases in the last year, which have had media attention.

The Child Abduction team have recently been involved in a number of High Court cases which have been reported giving guidance on the relationship between the laws in different countries, as they impact upon the welfare of children, and the correct country for which dispute concerning the children should be resolved.

In early 2006, the team acted for a former wife in connection with an issue concerning variation of maintenance. The High Court took the opportunity to give guidance for how such cases might be approached in future.

Early in the summer of 2006, Louise Higham acted for a father in an appeal to the Court of Appeal concerning issues regarding privacy, and the right for him to provide the media with details of his case. The Court of Appeal's Judgment opened the way for significantly greater reporting of decisions in cases involving children. This is seen as a great step forward for improving fairness in such proceedings.

On a general note, the House of Lords have handed down detailed guidance in connection with the way that the financial issues in a divorce should be handled, in the cases of Miller and McFarlane. It is hoped that the Judgments from the House of Lords will bring greater consistency to an area which is based upon judicial discretion.
