The Group
Lyons Davidson's Property Recovery Group was established on 1 September 2002, based in our Bristol office. Zak Browne, the Group’s partner in charge, joined Lyons Davidson in 2002 to take on and develop this work. The group has expanded considerably since that time and now forms part of LD's Recoveries Department.
The Service
We pursue claims on behalf of insurers to recover their outlay arising out of domestic and commercial property insurance claims. Such claims typically arise out of the following causes:
- Subsidence
- Fires
- Floods or EOW
- Other nuisance
- Builder’s negligence
- Vehicle impact
- Boundary disputes/trespass/adverse possession
In cases where the Insured is in fact the defendant to similar claims from others, we will also defend such claims under the Insured's Public Liability cover. We also intervene, as part of claims, to persuade a Third Party to remove their tree or abate other nuisances, or to gain access to neighbouring land or enforce Party Walls Act procedures.
We also advise insurers on policy disputes and fraudulent claims, and act on their behalf to recover sums paid to former policyholders.
Instructions may be handled for a fixed fee, or on a conditional fee or hourly rate basis.
Features of our Service
We are a dedicated team of over 15 lawyers specialising in the issues that are key to property recovery claims. Cases are delegated to a specific fee earner within the team, ensuring continuity between client and lawyer.
All our cases are managed through Lyons Davidson’s unique case management system, Filestream. This system is capable of producing bespoke Management Information reports on claims tailored to our clients' requirements. A secure link between the case management system and the Lyons Davidson Extranet enables our clients to access cases referred to us at any time via a secure, web-based platform.
Reporting, correspondence and billing is conducted electronically via email, through the Filestream case management system.
We offer training for claims handling staff and can advise on and develop Best Practice protocols for loss adjusters, engineers and claims handlers, if required.
